The Arcom's decision, dated July 22, 2026, states that Éditions Mengès has not fulfilled its legal obligations regarding the deposit of digital work files. These obligations, stipulated in the Intellectual Property Code (CPI), aim to facilitate access to works for people with disabilities.
Despite several reminders via emails and letters from the Arcom and the National Library of France, particularly between February 2023 and March 2026, the company has not responded to any deposit requests. A total of eight works are affected by these breaches, including titles such as 'Réactions : des atomes aux galaxies, au quotidien et dans l'univers' and 'Comment ça marche : les objets du quotidien passés au peigne fin'.
The Arcom emphasizes that the deposit of digital files is mandatory for publishers, especially upon request from the National Library of France, within a forty-five-day period. Éditions Mengès had cited issues related to the security of the PLATON platform and difficulties in coordinating with foreign rights contracts.
Consequently, Éditions Mengès is formally required to deposit the digital files for the eight works within two months of the decision's notification. They must also comply with legal obligations in the future. The decision will be published in the Official Journal of the French Republic and on the Authority's website.
